Terms and Condition

JobsinCanada.com is a career site and a service of VARiZE Marketing Inc. which provides "clients" businesses and organizations with online tools to assist in their recruiting efforts by promoting their employer brand for review by Job Seekers.

Acknowledgements

Subject in each case to the terms listed in the remainder of this Agreement, you hereby acknowledge and agree that:

  • JobsinCanada.com may only be used for lawful purposes. Any and all text and images you post on JobsinCanada.com or enter into its databases will be lawful by Canadian standards and suitable to a general audience.
  • JobsinCanada.com is not responsible for the content of linked sites or any possible harm caused by a linked site.
  • Images hosted by JobsinCanada.com should be backed up for your files. JobsinCanada.com will not be held not responsible should an image or images disappear.
  • For use in promoting your job listings and employer brand, JobsinCanada.com has the right to source and utilize publicly available images over the internet including images from your website.
  • The Services will be subject to fees and subscription fees as listed on the site. No fees will be applicable to any free trial period.
  • JobsinCanada.com has the right to make modifications to your information, listing and profile pages if required for visual, quality control or optimization purposes at its discretion. JobsinCanada.com will attempt to consult with you about any such modifications.
  • Content that deviates slightly from the JobsinCanada.com theme such as International employment content, or the promotion of non-employment related services may be subject to different pricing than is listed on the site.
  • Advertiser or Employer content will be activated only once payment has been made and accounts are current. Activation of accounts and content will usually take place within 24 hours of payment if content input has been completed however on occasion can take slightly longer.
  • JobsinCanada.com is not responsible for data obtained illegally or fraudulently.
  • Your listing and profile information will only be activated after it has been reviewed by a human for quality control purposes.
  • We reserve the right to accept or decline any advertiser or content at our own discretion.
  • Information you submit and the results achieved by using JobsinCanada.com’s services may be used by JobsinCanada.com for promotional purposes.
  • You agree to Opt-in to receive at least one of our marketing publications. Our publications contain an automated Opt-out feature. You are welcome to Opt-out at any time to discontinue receiving our newsletters by using the Opt-out feature or process described in the privacy policy page.
  • JobsinCanada.com is not responsible for damages of any kind no matter how damages may be caused.

Privacy

All parties to this agreement shall abide by the "Privacy Policy" listed on the JobsinCanada.com website.

Termination

You may terminate this Agreement at any time by calling JobsinCanada.com 604-628-2495. There are no refunds for any fees paid.

JobsinCanada.com may terminate this Agreement or the Services, disable your account or put your account on inactive status, at any time with or without cause, and with or without notice. JobsinCanada.com shall have no liability to you or any third party because of such termination or action.

JobsinCanada.com may delete any of your archived data within 10 days after the date of your account termination or trial end.

All sections of this Agreement that by their nature should survive termination will survive termination, including, without limitation, ownership, warranty disclaimers and limitations of liability.

JobsinCanada.com has the right to change any and all terms and conditions without notice. If changed and an issue arises the terms agreed to at the time of of the last agreement will apply. The client will be responsible for providing an original copy of such terms or the most recent terms may apply at JobsinCanada.com's sole discretion.

Your sole and exclusive remedy for any failure or non-performance of the Services shall be for JobsinCanada.com to use commercially reasonable efforts to adjust or repair the Services. USE OF THE SERVICES AND ANY RELIANCE BY YOU UPON THE SERVICES, INCLUDING ANY ACTION TAKEN BY YOU BECAUSE OF SUCH USE OR RELIANCE, IS AT YOUR SOLE RISK. JobsinCanada.com DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES UNLESS SPECIFICALLY AGREED TO IN WRITTING. THE SERVICES ARE PROVIDED "AS IS" AND JobsinCanada.com DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL JobsinCanada.com OR ANY OF ITS UNDERLYING SERVICE PROVIDERS, BUSINESS PARTNERS, INFORMATION PROVIDERS, ACCOUNT PROVIDERS, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, DISTRIBUTORS OR AGENTS (COLLECTIVELY REFERRED TO FOR PURPOSES OF THIS SECTION AS "JobsinCanada.com ") BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY MONEY DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, COVER, RELIANCE OR CONSEQUENTIAL DAMAGES, EVEN IF JobsinCanada.com SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. IN THE EVENT THAT NOTWITHSTANDING THE FOREGOING, JobsinCanada.com IS FOUND LIABLE TO YOU FOR DAMAGES FROM ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE), THE LIABILITY OF JobsinCanada.com TO YOU WILL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES.

Miscellaneous

No agency, partnership, joint venture, or employment is created as a result of the Agreement, and you do not have any authority of any kind to bind JobsinCanada.com in any respect whatsoever. In any action or proceeding to enforce rights under the Agreement, the prevailing party will be entitled to recover its costs and attorneys' fees. The Agreement shall be governed by the laws of the Province of British Columbia, Canada without regard to its choice or law or conflict of laws provisions. All legal actions in connection with the Agreement shall be brought in the Province of British Columbia. The Services are available only to persons who can form legally binding contracts under applicable law. Without limiting the foregoing, the Services are not available to individuals under the age of 18. If you do not qualify, you are not permitted to use the Services.
